LOCAL LAW NO 1 OF THE YEAR 1988
A local law PROVIDING THAT IT SHALL BE UNLAWFUL TO DUMP ANY OUT-OF-STATE SOURCE GARBAGE, DEBRIS, OR REFUSE AT THE TOWN OF HANCOCK TRANSFER STATION
Be it enacted by the Town Board of the Town of Hancock as follows:
SECTION 1. It shall be unlawful for any individual, partnership, unincorporated association or corporation to dump any garbage, or refuse at the Town of Hancock Transfer Station which has been generated as garbage, debris or refuse outside of the State of New York.
SECTION 2. The Town Board of the Town of Hancock shall by its resolution be authorized to delegate to the appropriate local official the power to enforce this Local Law.
SECTION 3. Enforcement of this Local Law shall be initiated in the Town of Hancock Justice Court by the issuance of an appearance ticket.
SECTION 4. Violation of this section shall be deemed an offense against this Local Law and shall be punishable by a fine not to exceed $500.00 or by imprisonment for not more than 15 days or both.
SECTION 5. Insofar as the provisions of this Local Law are inconsistent with the provisions of any other local law or act, the provisions of this local law shall be controlling.
SECTION 6. This local law shall take effect on the twentieth day following its enactment.
I hereby certify that the local law annexed hereto, designated as local law 1 of 1988 of the Town of Hancock was duly passed by the Town Board on March 16, 1988 in accordance with the applicable provisions of law.
I further certify that I have compared the preceding local law with the original on file in this office and that the same is a correct transcript there from and of the whole of such original local law, and was finally adopted in the manner indicated in paragraph 1 above.
